As the number of COVID-19 cases has grown nationwide, it is not been a surprise to most employers that lawsuits were not too far behind. Unfortunately, that scenario has proved true as more and more lawsuits are being filed against employees based on claims associated with the COVID-19 pandemic.

One of the first cases involving COVID-19 was brought as a wrongful death action against Walmart for the death of one of its employees in Illinois. It is clear that more and more plaintiffs’ lawyers are going to be focusing on employees who are hospitalized as well as, those who have died by trying to get around the Worker's Comp protection for employers and bring a wrongful death suit against the employer.

In addition to wrongful death lawsuits, employers are now being served with personal injury lawsuits for failing to provide proper protection of its employees to the COVID-19 virus while at work. Furthermore, you are seeing significant increase in the number of complaints filed by employees with OSHA alleging failure to protect the employees while at work.

OSHA has also started investigating some of these complaints to determine where employees have failed to provide the proper protection and issuing possible citations under the Act’s General Duty Clause. Employers will need to be more proactive prior to receiving any lawsuits or OSHA complaints in order to ensure they are protected to the full extent possible from these types of lawsuits or inspections.

This program will examine the different types of potential lawsuits and other legal actions that could be brought against employers under the COVID-19 pandemic. This webinar will also examine ways for employees to avoid such lawsuits and inspections and what to do when a lawsuit or an OSHA complaint is filed.

Course Objectives:

• This program will discuss guidance provided by different federal agencies, including the Center for Disease Control, OSHA, and the EEOC.

• Identify proactive steps employers can take to prevent lawsuits and guidelines to be followed in returning employees back to work.

• Examine education and training of employees as to the potential exposure to COVID-19 the warning signs and medical symptoms to be aware of
